Terms and Conditions

Article 1 – Definitions
In these Terms and Conditions, the following definitions shall apply:
Cooling-off Period: the period during which the consumer may exercise the right of withdrawal;
Consumer: the natural person who is not acting for purposes related to a trade, business, or profession and who enters into a distance contract with the entrepreneur;
Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers;
Terms and Conditions: these present Terms and Conditions of the entrepreneur.

Article 2 – Applicability
These Terms and Conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.

Article 3 – The Offer
The entrepreneur shall provide a complete and accurate description of the products and/or services offered. Product images are intended to represent the products as accurately as possible; however, slight variations in color or appearance may occur.

Article 4 – The Agreement
The agreement is formed at the moment the consumer accepts the offer and complies with the conditions set by the entrepreneur.

Article 5 – Right of Withdrawal
The consumer has the right to cancel the agreement within 14 days after receiving the products, unless a statutory exception applies as set out in Article 7.

Article 6 – Costs in the Event of Withdrawal
The cost of return shipping shall be borne by the consumer. Any amounts already paid shall be refunded within 14 days after cancellation, provided the returned product has been received by the entrepreneur.

Article 7 – Exclusion of the Right of Withdrawal
The right of withdrawal may be excluded for:

  • Products that cannot be returned for hygiene reasons once the seal has been broken, including skincare and cosmetic products;

  • Products that are clearly personal in nature;

  • Products that are liable to deteriorate or expire rapidly.

Article 8 – Pricing
All prices are subject to typographical and printing errors. In the event of an obvious pricing error, the entrepreneur shall not be obligated to supply the product at the incorrect price.

Article 9 – Conformity and Warranty
The entrepreneur warrants that the products conform to the agreement. Any warranty shall apply in accordance with the manufacturer's warranty, where applicable.

Article 10 – Delivery and Performance
The entrepreneur shall exercise due care in processing and fulfilling orders and aims to complete delivery within 30 days at the latest.

Article 11 – Ongoing Agreements: Duration, Termination, and Renewal
The consumer may terminate agreements entered into for an indefinite period at any time, subject to a notice period of no more than one month.

Article 12 – Payment
Payment must be made within 7 business days after the start of the cooling-off period, unless otherwise agreed in writing.

Article 13 – Complaints Procedure
Complaints regarding the performance of the agreement must be submitted in writing within 7 days after the consumer has identified the issue. The entrepreneur shall respond within 14 days of receipt.

Article 14 – Disputes
All agreements between the entrepreneur and the consumer shall be governed exclusively by Dutch law.

Article 15 – Personal Information
The processing of personal data is governed by the privacy policy of FEA SKINCARE.

Article 16 – Errors, Inaccuracies, and Omissions
The entrepreneur reserves the right to correct any errors, inaccuracies, or omissions in product information, pricing, or other published content.

Article 17 – Changes to the Terms and Conditions
FEA SKINCARE reserves the right to amend these Terms and Conditions at any time.

Article 18 – CESOP
In connection with European legislation (CESOP), payment data may be recorded in the applicable European system where required by law.

Article 19 – Force Majeure
The entrepreneur shall not be liable for any delay or failure to perform resulting from circumstances beyond its reasonable control, including but not limited to strikes, natural disasters, pandemics, or other events of force majeure.

Article 20 – Liability
The entrepreneur's liability shall be limited to the amount of the relevant order, unless the damage is caused by willful misconduct or gross negligence.

Article 21 – Limitation of Liability
To the fullest extent permitted by applicable law, our total liability shall not exceed the purchase price of the product giving rise to the claim. The entrepreneur shall not be liable for any indirect, incidental, special, consequential, or punitive damages of any kind, including but not limited to loss of profits, loss of data, or loss of goodwill, arising out of or in connection with the use of the products or the website.

Article 22 – Skincare Products: Ingredients, Allergies, Use, and Disclaimer
The products offered by the entrepreneur are cosmetic products intended for external use only.
They are not intended to diagnose, treat, cure, or prevent any disease.
The statements made regarding these products have not been evaluated by the Food and Drug Administration.
The consumer is responsible for reviewing the ingredient list before using any product.
Consumers with allergies, sensitivities, or reactive skin are advised to perform a patch test before full use.
Products must be used only in accordance with the instructions provided.
The entrepreneur shall not be liable for skin irritation, allergic reactions, or other adverse effects resulting from failure to follow the provided product information, warnings, or instructions.

Article 23 – Final Provisions
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
